ORDINANCE AMENDING AN ORDINANCE ESTABLISHING PROPERTY MAINTENANCE STANDARDS FOR THE TOWNSHIP OF SHREWSBURY
WHEREAS Shrewsbury Township adopted an Ordinance establishing property maintenance standards for the Township of Shrewsbury on April 12, 2005; and
WHEREAS Shrewsbury Township amended Ordinance #3.22.05 on July 10, 2012; and
WHEREAS Shrewsbury Township intends to amend the aforesaid in order to adopt the International Property Maintenance Code.
NOW, THEREFORE BE IT ORDAINED by the Mayor and Township Committee of the Township of Shrewsbury that Ordinance establishing property maintenance standards for the Township of Shrewsbury is hereby amended as follows:
Section I. DEFINITIONS
a. Brush - Discarded limbs, twigs and other portions of trees that are discarded when trimming or cutting of trees and other limbs, twigs and other portions of trees that have fallen from trees and any collection of bushes, undergrowth, twigs and limbs and other discarded portions of trees.
b. Litter – Any used or unconsumed substance or waste material which has been discarded whether made of aluminum, glass, plastic, rubber, paper or other natural or synthetic material or any combination thereof, including but not limited to any bottle, jar or can or any top, cap or detachable tab of any bottle, jar or can, any unlighted cigarette, cigar, match or any flaming or glowing material, or any garbage, trash, refuge, debris, rubbish, grass clippings or other lawn or garden waste, newspaper, magazines, glass, metal, plastic, paper containers or other packaging or construction material.
c. Motor Vehicle – Any automobile, omnibus, road tractor, trailer, truck, truck tractor, motorcycle, moped, boat trailer or vehicle as defined in N.J.S.A. 39:1-1.
d. Owner – Generally refers to the person who possesses title to the property. In the case of a cooperative, the owner is the cooperative association. In case of condominium the owner is owner of unit and/or association.
e. Person in Control – Is a person or entity who lacks title to property but is in possession and control either as a tenant or under other form of contract relationship with owner.
f. Debris – Scattered remains or matter broken, destroyed or discarded.
g. Construction Materials – Items of tangible personal property purchased by an owner, tenant or contractor for incorporation into property as a physical component part of such property to be utilized or having been utilized for construction purposes.
h. Bulky Trash – Large items of solid waste which because of their size or weight require handling other than normal use for municipal waste, and includes but is not limited to tree trunks, auto bodies, large household appliances, furniture and drums.
Section II. ADOPTION OF INTERNATIONAL PROPERTY MAINTENANCE CODE
A certain document, which is on file at the Office of the Township Clerk, being designated as the “2018 International Property Maintenance Code” be and is hereby adopted as the Property Maintenance Code of the Township of Shrewsbury, County of Monmouth and State of New Jersey, for the control of buildings and structures as herein provided and property maintenance and each and all of the regulations, provisions, penalties, conditions and terms of the International Property Maintenance Code (referred to as IPMC) are hereby referred to, adopted and made a part hereof as if fully set out in the Chapter with the additions, insertions, deletions and changes, if any, prescribed below.
Section III. ADDITIONS, INSERTIONS AND CHANGES
The International Property Maintenance Code is amended and revised in the following respects:
Page numbers referred to the location of amendments in the document marked and designated as the “International Property Maintenance Code,” a copy of which is on file in the Clerk’s office of Shrewsbury Township and remains in full effect as authorized by the adoption of this Ordinance and allows for future additions, insertions and changes. Section I through X continue to be incorporated in the Property Maintenance Ordinance in addition to the International Property Maintenance Code, but where there is a conflict, the International Property Maintenance Code shall take preference.
Section IV. EXTERIOR PROPERTY AREAS
The owner and person in control of each premises or entity in the
Township shall maintain the exterior property and confines with the following regulations:
Sanitation – All exterior property and premises shall be maintained in a clean, safe and sanitary condition. The occupant shall be responsible for that part of the exterior property which such occupant occupies or controls in a clean and sanitary condition and free of hazards and nuisances. The owner shall be responsible for the entire property owned.
Sidewalks and Driveways – all sidewalks, walkways, stairs, driveways and parking spaces in similar areas shall be kept in a proper state of repair, and maintained free from hazardous conditions.
c. Removal of Weeds, Brush and Other Impediments – all premises and exterior property shall be maintained free from weeds, grass, brush or plant growth in excess of ten (10”) inches. All noxious weeds, dead and dying trees, stumps, roots, obnoxious growths, filth, garbage, trash and debris shall be removed where the same are inimical to the preservation of public health, safety or the general welfare of the Township residents or which may constitute a fire hazard. Weeds and grass shall be defined as all grasses, annual plants and vegetation, other than trees or shrubs provided; however, that this term shall not include cultivated flowers and gardens.
d. Public Streets and Sidewalks – The owner or owners, person in control,
tenant or tenants of all lands abutting on any highway or public street or avenue in the Township shall remove all grass, weeds, brush and other impediments and shall trim where deemed necessary trees, bushes and hedges where they serve as impediments of part of the street, avenue, or highway, sidewalks or gutters bordering or abutting to said lands.
e. Inoperable and Abandoned Motor Vehicles and Boats and Bulky Trash and Construction Debris - The owner and owners, tenant or tenant and persons in control of all lands, shall not leave or store any inoperable motor vehicle, abandoned vehicle or boat on any public lands or private premises, for a period of more than 5 days, or leave any bulky trash or construction debris on public or private premises, exterior to any building, for a period in excess of 48 hours.
f. Abutting Owners to Pay and Maintain Sidewalks – It is hereby made the
duty of the respective owners of land fronting or abutting any existing sidewalk to:
Pave, maintain and keep and repair the sidewalks in front of or abutting upon said respective lands in the manner provided by this Ordinance.
Replace immediately any sidewalk that may become broken.
g. Abutting Owners to bear costs of Paving and Repair, Permit
Requirement: Conformity with Township Specifications - The full cost of the paving of said sidewalks, including costs of inspection by the Township Engineer shall be borne by the abutting property owner. Materials furnished and workmanship performed in the construction of all sidewalks shall be in strict conformity to the standard specifications for sidewalk construction adopted by and recommended by the Township Engineer. Any person desiring to pave or repair any sidewalks shall obtain a permit from the Township Clerk, said application of which shall be reviewed by the Township Engineer in terms of material and design and approved or disapproved based on the Township Engineer’s standards. The permit fee to lay sidewalks and curbs shall be $25.00 for each 25 linear ft. of frontage or a part thereof.
h. Sewer and Water Lateral Maintenance.
Definition of Sewer or Water Lateral: Shall mean the sanitary sewer or water line running from the water or sewer main, if the water or sewer line is installed within the street cartway. If the sanitary sewer main or water main is installed in the sidewalk area or within the easement area, then the line running from the saddle or fitting at the connection point to the main to the private unit.
Maintenance by Customer or Private Property Owner: All connections or laterals, whether water or sewer, from the main, saddle, clean out or curb stop, whichever is reached first, to the customer or private property owner’s building, shall be maintained by the customer or private property owner in good order. All leaks in such connections or laterals, whether sewer or water, must be repaired immediately by the owner or occupant of the private premises. The customer or owner shall be responsible for notifying the Township of Shrewsbury of the party contracted to do any work on the customer or property owner’s building or lateral prior to the work being commenced and shall follow all of the ordinances of the Township concerning such construction. Any work not acceptable or in violation of local ordinance or state law shall immediately be removed and replaced by work that is acceptable.
Township Responsibility: The Township shall not be responsible for maintaining any portion of the building, sewer or water line or lateral or connection from the property owner’s building to the main, clean out, saddle of main or curb stop, whichever is reached first, or for damage done by sewer or water escaping therefrom, or from lines or fixtures of the customer’s property; and the customer shall at all times comply with applicable regulations with respect thereto and make changes that are required. The Township shall only be responsible while it owns the sewer and water mains for the maintenance and repair of sewer and water mains found in the public roads or in public easements or underneath public sidewalks.
Section V. NOTICE OF FAILURE TO COMPLY WITH PROPERTY MAINTENANCE ORDINANCE
The special code enforcement officer or other designated officer zoning officer or other designated officer is authorized to notify, in writing by mailing by Certified Mail, return receipt requested and regular mail or hand delivering to the owner and/or person or entity in control of the subject premises and/or the agent of the owner, person in control or entity advising him or the entity of the particular violation. The person or entity shall have 24 hours from the date of receipt of the notice to cure the violation unless an extension is granted by Special Code Enforcement Officer or designated person. Said notice shall be deemed to serve as a continuing notice for the remainder of the calendar year and the Township may, without further notice, cut, destroy and/or correct any existing violation on the subject property in accordance with the provisions of this ordinance.
Section VI. FAILURE OR REFUSAL TO COMPLY WITH PROPERTY MAINTENANCE LAW
Upon failure, neglect or refusal of any owner and/or person or entity in control and/or his
or its agent to cut, destroy and remove any weeds, grass, growing, lying or located on the owner’s property or remove any inoperable, abandoned motor vehicle, boat, bulky trash or construction debris located on the owner’s and/or person in control’s property in order to correct conditions in violation of this Ordinance within the 24 hour period prescribed by this Ordinance, then the Township is authorized to cut, destroy and remove any weeds or grass or inoperable abandoned motor vehicles or boats or bulky trash or construction debris or correct any violation in order to pay for the cutting, destroying or removal of weeds and grass, inoperable or abandoned motor vehicles or boats or bulky trash or construction debris or the correction of said violation.
In regards to water and sewer laterals, upon failure, neglect or refusal of any owner and/or
person or entity in control and/or its agent to maintain, repair or replace, where needed, a water or sewer lateral as defined above, in violation of this Ordinance within 24 hours of the violation being realized or sooner in cases of emergency, the Township may take action to remove or repair any leaking water or sewer lateral subject to Section VII.
Section VII. UNPAID CHARGES TO CONSTITUTE LIEN ON PROPERTY
Should the Township be required to cut, destroy and remove weeds and/or grass or correct
any violation of this Ordinance, the Special Code Enforcement Officer or other designated individual shall certify the cost thereof to the Township Committee, who shall examine the certificate and, if found correct, authorize the forwarding of a bill to the property owner and/or person in control for payment within thirty (30) days of the date of the bill. The amount of the charges shall become a lien upon the lands and shall be added to and become part of the taxes to be assessed upon those lands, and to bear interest at the same rate as taxes. The cost shall be in addition to any penalties imposed for any violation of this Section.
With regards to any repairs or removals of water or sewer laterals per Section VI of this
Ordinance by the Township, the Township Committee shall certify the cost of such repair or removal upon approval of such costs and shall forward a bill to the property owner and/or person in control for payment within thirty (30) days of the date of the bill. The amount of the charges shall become a lien upon the lands and shall be added to and become part of the taxes to be assessed upon those lands, and to bear interest at the same rate as taxes should said bill not be paid within the time period prescribed by this Ordinance. The cost shall be in addition to any penalties imposed by any violation of this Section.
Section VIII. OTHER VIOLATIONS
In the event that a person or entity fails to comply with this ordinance by committing an
unlawful act, a fine of no less than Five Hundred ($500.00) Dollars shall be imposed for each violation is cured within the time period prescribed by Section V involving notice to the property owner and/or person or entity in control. The issuance of a summons for violation of the aforesaid ordinance by the special code enforcement officer or other designated officer shall be in addition to the lien provisions set forth above.
Section IX. ENFORCEMENT OF OTHER LAWS OR ORDINANCES NOT IMPAIRED
The maintenance ordinance standards and regulations shall be in addition to the provisions of any other applicable ordinance, law, rule or regulation. Nothing in this ordinance shall be construed to impair or prevent enforcement of any other ordinance, law, rule or regulation.
Section X. SEVERABILITY
In the event any provision of this ordinance is stricken by a court for any reason, the
remaining provisions of the ordinance shall remain valid and in full force and effect notwithstanding the stricken provision.
All Ordinances or parts of Ordinances of the Township of Shrewsbury in conflict or inconsistent with this Ordinance are hereby repealed, but only, however, to the extent of such conflict or inconsistencies; it being the legislative intent that all other Ordinances or parts of Ordinances now existing and in effect, unless the same be in conflict or inconsistent with any of the provisions of this Ordinance, shall remain in full force and effect.
The above Ordinance shall be effective upon publication in accordance with the law and
subject to approvals, if necessary.

ORDINANCE REQUIRING THE RETROFITTING OF EXISTING STORM DRAIN INLETS IN THE TOWNSHIP OF SHREWSBURY, MONMOUTH COUNTY, NEW JERSEY
SECTION I. Purpose: An ordinance requiring the retrofitting of existing storm drain inlets which are in direct contact with repaving, repairing, reconstruction, or resurfacing or alterations of facilities on private property, to prevent the discharge of solids and floatable (such as plastic
bottles, cans, food wrappers and other litter) to the municipal separate storm sewer system(s) operated by the Township of Shrewsbury to protect the environment, public health, safety, and welfare, and to prescribe penalties for failure to comply. Installation of all new storm drain inlets must include a catch basin or other BMP designed for solids collection in areas which drain to surface waters and that do not have any other downstream BMPS prior to the surface water discharge.
SECTION II. Definitions: For the purpose of this ordinance, the following terms, phrases, words, and their derivations shall have the meanings stated herein unless their use in the text of this Chapter clearly demonstrates a different meaning. When consistent with the context, words used in the present tense include the future, words used in the plural number include the singular number, and words used in the singular number include the plural number. The word “shall” is always mandatory and not merely directory.
A. “Municipal separate storm sewer system (MS4)” means a conveyance or system of conveyances (including roads with drainage systems, municipal streets, catch basins, curbs, gutters, ditches, manmade channels, or storm drains) that is owned or operated by [insert name of municipality] or other public body, and is designed and used for collecting and conveying stormwater.
NOTE: In municipalities with combined sewer systems, add the following: “MS4s do not include combined sewer systems, which are sewer systems that are designed to carry sanitary sewage at all times and to collect and transport stormwater from streets and other sources.”
B. “Person” means any individual, corporation, company, partnership, firm, association, or political subdivision of this State subject to municipal jurisdiction.
C. “Storm drain inlet” means the point of entry into the storm sewer system.
SECTION III. Regulated Activities:
A. No person in control of private property (except a residential lot with one single family house) shall authorize the repaving, repairing (excluding the repair of individual potholes), resurfacing (including top coating or chip sealing with asphalt emulsion or a thin base of hot bitumen), reconstructing or altering any surface that is in direct contact with an existing storm drain inlet on that property unless the storm drain inlet either:
1. Already meets the design standard below to control passage of solid and floatable materials; or
2. Is retrofitted or replaced to meet the standard in Section IV below prior to the completion of the project.
B. The below design standard applies to the following types of storm drain inlet retrofit projects unless a more stringent standard is specified by the municipality’s Stormwater Control Ordinance:
1. Privately-owned or operated storm drain inlets (e.g., condominium association) must be retrofitted where the storm drains are:
a. In direct contact with any repaving, repairing (excluding individual pothole repair), or resurfacing (including top coating or chip sealing with asphalt emulsion or a thin base of hot bitumen); or
b. In direct contact with any reconstruction or alteration of facilities. This does not include single family homes.
C. Grates in pavement or other ground surfaces shall meet either of the following standards:
1. The New Jersey Department of Transportation (NJDOT) bicycle safe grate standards described in Chapter 2.4 of the NJDOT Bicycle Compatible Roadways and Bikeways Planning and Design Guidelines (see
www.state.nj.us/transportation/about/publicat/pdf/BikeComp-/introtofac.pdf); or
2. A grate where each individual clear space in that grate has an area of no more than seven (7.0) square inches or is not greater than 0.5 inches across the smallest dimension. Note that the Residential Site Improvement Standards at N.J.A.C. 5:21 include requirements for bicycle safe grates.
a. Examples of grates subject to this standard include grates in grate inlets; the grate portion (non-curb opening portion) of combination inlets; grates on storm sewer manholes; ditch grates; trench grates; and grates of spacer bars in slotted drains. Examples of ground surfaces include surfaces of roads, (including bridges), driveways, parking areas, bikeways, plazas, sidewalks, lawns, fields, open channels, and stormwater basin floors used to collect stormwater from the surface into a storm drain or surface water body.
b. For curb-openings inlets, including curb-opening inlets in combination inlets, the clear space in the curb opening, or each individual clear space if the curb opening has two or more clear spaces, shall have an area of no more than seven (7.0) square inches or be no greater than two (2.0) inches across the smallest dimension.
SECTION IV. Exemptions:
The following exemptions from the design standard apply:
A. Where each individual clear space in the curb opening in existing curb-opening inlets does not have an area of more than nine (9.0) square inches;
B. Where the review agency determines that the standards would cause inadequate hydraulic performance that could not practicably be overcome by using additional or larger storm drain inlets;
C. Where flows from the water quality design storm as specified in N.J.A.C. 7:8 are conveyed through any device (e.g., manufactured treatment device, or a catch basin hood) that is designed, at a minimum, to prevent delivery of all solid and floatable materials that could not pass through one of the following:
1. A rectangular space four and five-eighths inches long and one and one-half inches wide; or
2. A bar screen having a bar spacing of 0.5 inches;
a. Note that these exemptions do not authorize any infringement of requirements in the Residential Site Improvement Standards for bicycle safe grates in new residential development (N.J.A.C. 5:21-4.18(b)2 and 7.4(b)1).
D. Where flows are conveyed through a trash rack that has parallel bars with one inch (1”) spacing between the bars, to the elevation of the water quality design storm as specified in N.J.A.C. 7:8; or
E. Where the Department determines, pursuant to the New Jersey Register of Historic Places Rules at N.J.A.C. 7:4-7.2(c), that action to meet the standard is an undertaking that constitutes an encroachment or will damage or destroy the New Jersey Register listed historic property.
SECTION V. Enforcement:
This ordinance shall be enforced by the Code Enforcement Officer.
SECTION VI. Violations and Penalties:
Any person(s) who is found to be in violation of the provisions of this ordinance shall be
subject to a fine not to exceed $2,000.00 for each storm drain inlet that is not
retrofitted to meet the design standard.
SECTION VII. Severability:
Each section, subsection, sentence, clause, and phrase of this Ordinance is declared to
be an independent section, subsection, sentence, clause and phrase, and the finding or
holding of any such portion of this Ordinance to be unconstitutional, void, or ineffective
for any cause, or reason, shall not affect any other portion of this Ordinance.
SECTION VIII. Effective Date:
This Ordinance shall be in full force and effect from and after its adoption and any
publication as may be required by law.
All Ordinances or parts of Ordinances that are inconsistent herewith are repealed, but only to the extent of such inconsistency.

ORDINANCE ADOPTING REGULATIONS FOR PRIVATELY-OWNED SALT STORAGE OR DE-ICING MATERIALS IN THE TOWNSHIP OF SHREWSBURY, MONMOUTH COUNTY, NEW JERSEY
SECTION I. Purpose: The purpose of this ordinance is to prevent stored salt and other solid de-icing materials from being exposed to stormwater.
This ordinance establishes requirements for the storage of salt and other solid de-icing materials on properties not owned or operated by the municipality (privately-owned), including residences, in Township of Shrewsbury to protect the environment, public health, safety and welfare, and to prescribe penalties for failure to comply.
SECTION II. Definitions: For the purpose of this ordinance, the following terms, phrases, words, and their derivations shall have the meanings stated herein unless their use in the text of this Chapter clearly demonstrates a different meaning. When consistent with the context, words used in the present tense include the future, words used in the plural number include the singular number, and words used in the singular number include the plural number. The word “shall” is always mandatory and not merely directory.
“De-icing materials” means any granular or solid material such as melting salt or any other granular solid that assists in the melting of snow.
“Impervious surface” means a surface that has been covered with a layer of material so that it is highly resistant to infiltration by water.
“Storm drain inlet” means the point of entry into the storm sewer system.
“Permanent structure” means a permanent building or permanent structure that is anchored to a permanent foundation with an impermeable floor, and that is completely roofed and walled (new structures require a door or other means of sealing the access way from wind driven rainfall).
A fabric frame structure is a permanent structure if it meets the following specifications:
Concrete blocks, jersey barriers or other similar material shall be placed around the interior of the structure to protect the side walls during loading and unloading of de-icing materials;
The design shall prevent stormwater run-on and run through, and the fabric cannot leak;
The structure shall be erected on an impermeable slab;
The structure cannot be open sided; and
The structure shall have a roll up door or other means of sealing the access way from wind driven rainfall.
“Person” means any individual, corporation, company, partnership, firm, association, or political subdivision of this State subject to municipal jurisdiction.
“Resident” means a person who resides on a residential property where de-icing material is stored.
SECTION III. Deicing Material Storage Requirements:
Temporary outdoor storage of de-icing materials in accordance with the requirements below is allowed between October 15th and April 15th:
Loose materials shall be placed on a flat, impervious surface in a manner that prevents stormwater run-through;
Loose materials shall be placed at least 50 feet from surface water bodies, storm drain inlets, ditches and/or other stormwater conveyance channels;
Loose materials shall be maintained in a cone-shaped storage pile. If loading or unloading activities alter the cone-shape during daily activities, tracked materials shall be swept back into the storage pile, and the storage pile shall be reshaped into a cone after use;
Loose materials shall be covered as follows:
The cover shall be waterproof, impermeable, and flexible;
The cover shall extend to the base of the pile(s).
The cover shall be free from holes or tears;
The cover shall be secured and weighed down around the perimeter to prevent removal by wind; and
Weight shall be placed on the cover(s) in such a way that minimizes the potential of exposure as materials shift and runoff flows down to the base of the pile.
Sandbags lashed together with rope or cable and placed uniformly over the flexible cover, or poly-cord nets provide a suitable method. Items that can potentially hold water (e.g., old tires) shall not be used;
Containers must be sealed when not in use; and
The site shall be free of all de-icing materials between April 16th and October 14th.
De-icing materials should be stored in a permanent structure if a suitable storage structure is available. For storage of loose de-icing materials in a permanent structure, such storage may be permanent, and thus not restricted to October 15 -April 15.
All such temporary and/or permanent structures must also comply with all other local ordinances, including building and zoning regulations.
The property owner, or owner of the de-icing materials if different, shall designate a person(s) responsible for operations at the site where these materials are stored outdoors, and who shall document that weekly inspections are conducted to ensure that the conditions of this ordinance are met. Inspection records shall be kept on site and made available to the municipality upon request.
Residents who operate businesses from their homes that utilize de-icing materials are required to perform weekly inspections.
SECTION IV. Exemptions: Residents may store de-icing materials outside in a solid-walled, closed container that prevents precipitation from entering and exiting the container, and which prevents the de-icing materials from leaking or spilling out. Under these circumstances, weekly inspections are not necessary, but repair or replacement of damaged or inadequate containers shall occur within 2 weeks.
If containerized (in bags or buckets) de-icing materials are stored within a permanent structure, they are not subject to the storage and inspection requirements in Section III above. Piles of de-icing materials are not exempt, even if stored in a permanent structure.
This ordinance does not apply to facilities where the stormwater discharges from de-icing material storage activities are regulated under another NJPDES permit.
SECTION V. Enforcement: This ordinance shall be enforced by the Code Enforcement Officer during the course of ordinary enforcement duties.
SECTION VI. Violations and Penalties: Any person(s) who is found to be in violation of the provisions of this ordinance shall have 72 hours to complete corrective action. Repeat violations and/or failure to complete corrective action shall result in fines as follows: upon conviction, be subject to a fine not exceeding $2,000.00. A term of imprisonment not exceeding 90 days or a period of community service not exceeding 90 days or any combination thereof.
SECTION VII. Severability: Each section, subsection, sentence, clause, and phrase of this Ordinance is declared to be an independent section, subsection, sentence, clause, and phrase, and finding or holding of any such portion of this Ordinance to be unconstitutional, void, or ineffective for any cause or reason shall not affect any other portion of this Ordinance.
SECTION VIII. Effective Date: This Ordinance shall be in full force and effect from and after its adoption and any publication as may be required by law.
All Ordinances or parts of Ordinances that are inconsistent herewith are repealed, but only to the extent of such inconsistency.

AN ORDINANCE TO AMEND THE 2017 ORDINANCE OF THE TOWNSHIP OF SHREWSBURY, COUNTY OF MONMOUTH, STATE OF NEW JERSEY ENTITLED “AN ORDINANCE AMENDING FEES OF PLENARY RETAIL DISTRIBUTION LICENSE FEES “TO CHANGE THE AMOUNT FOR THE ANNUAL RENEWAL OF PLENARY RETAIL DISTRIBUTION LICENSE
WHEREAS in accordance with N.J.S.A. 33:1-12, the following increase reflects a 20% increase of the 20% statutory limit allowed by a licensing agent for annual liquor license fees not to exceed $2,500 for a Class D Plenary Retail Distribution License,
WHEREAS the last increase in the fee for a Class D Plenary Retail Distribution License in Shrewsbury Township was enacted in 2017, AN ORDINANCE AMENDING FEES OF PLENARY RETAIL DISTRIBUTION LICENSE FEES IN SHREWSBURY TOWNSHIP is
hereby amended and supplemented as follows
Section I: The annual fee for a Class D Plenary Retail Distribution License is hereby amended to change the fees for a Class D Plenary Retail Distribution from $792 to $950. The fee specified shall take effect upon the effective date of this ordinance and shall apply to all applications for a Plenary Retail Distribution License until the same shall be changed as provided by N.J.S.A. 33:1-12.
Section II: All ordinances and provisions of the Ordinances of the Township of Shrewsbury thereof inconsistent with the provisions of this ordinance shall be and are hereby repealed to the extent of such inconsistency. If any section, subsection, part, clause or phrase of this ordinance shall be declared invalid by judgment of any court of competent jurisdiction, such shall be deemed severable from the remainder of the ordinance section, subsection, part, clause or phrase shall be deemed severable from the remainder of this ordinance, and
Section III: This ordinance shall take effect immediately after final passage and publication as required by law.

CALENDAR YEAR 2024 ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK (N.J.S.A. 40A: 4-45.14)
WHEREAS, the Local Government Cap Law, N.J.S. 40A: 4-45.1 et seq., provides that in the preparation of its annual budget, a municipality shall limit any increase in said budget up to 2.5% unless authorized by ordinance to increase it to 3.5% over the previous year’s final appropriations, subject to certain exceptions; and,
WHEREAS, N.J.S.A. 40A: 4-45.15a provides that a municipality may, when authorized by ordinance, appropriate the difference between the amount of its actual final appropriation and the 3.5% percentage rate as an exception to its final appropriations in either of the next two succeeding years; and,
WHEREAS, the Township Committee of the Township of Shrewsbury in the County of Monmouth finds it advisable and necessary to increase its CY 2024 budget by up to 3.5% over the previous year’s final appropriations, in the interest of promoting the health, safety and welfare of the citizens; and,
WHEREAS, the Township Committee hereby determines that a 3.5 % increase in the budget for said year, amounting to $ 6,866.00 in excess of the increase in final appropriations otherwise permitted by the Local Government Cap Law, is advisable and necessary; and,
WHEREAS the Township Committee hereby determines that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years.
NOW THEREFORE BE IT ORDAINED, by the Township Committee of the Township of Shrewsbury, in the County of Monmouth, a majority of the full authorized membership of this governing body affirmatively concurring, that, in the CY 2024 budget year, the final appropriations of the Township of Shrewsbury shall, in accordance with this ordinance and N.J.S.A. 40A: 4-45.14, be increased by 3.5%, amounting to $710,631.00 and that the CY 2024 municipal budget for the Township of Shrewsbury be approved and adopted in accordance with this ordinance; and,
BE IT FURTHER ORDAINED, that any that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years; and,
BE IT FURTHER ORDAINED, that a certified copy of this ordinance as introduced be filed with the Director of the Division of Local Government Services within 5 days of introduction; and,
BE IT FURTHER ORDAINED, that a certified copy of this ordinance upon adoption, with the recorded vote included thereon, be filed with said Director within 5 days after such adoption.

REVISED SALARY ORDINANCE TOWNSHIP OF SHREWSBURY AN ORDINANCE TO AMEND ORDINANCE 2022-05 ENTITLED "AN ORDINANCE FIXING SALARY AND COMPENSATION OF CERTAIN OFFICES, POSITIONS AND EMPLOYEES IN THE TOWNSHIP OF SHREWSBURY, COUNTY OF MONMOUTH, STATE OF NEW JERSEY FOR THE YEAR 2024" AND THEREAFTER KNOWN BY ITS SHORT NAME AS ‘SHREWSBURY TOWNSHIP SALARY ORDINANCE'
BE IT ORDAINED, by the Township Committee of the Township of Shrewsbury in the County of Monmouth and State of New Jersey:
SECTION 1. The offices and positions under the Municipal Government of the Township of Shrewsbury shall be compensated at the amount fixed in this Ordinance.
SECTION 2. The Township Chief Financial Officer is hereby authorized to transfer such sums of money from the Municipal Current Account and other such accounts that may cover periodic payrolls in the amounts fixed by this Ordinance.
SECTION 3. Effective January 1, 2024, all employees, eligible for health insurance shall contribute of salary towards health benefits based on the annual premium for all health care and prescription premiums as set forth in the schedule promulgated by the NJ Division of Pensions and Benefits herein attached and as revised from time to time. The minimum contribution shall be equal to 1.5% of the employee’s salary.
SECTION 4. The following listed positions are assigned to the following titles with annual salary ranges, providing for minimum and maximum salaries, contingent on merit, the availability of funds, and other provisions of this Ordinance. The Township Committee shall pass an annual resolution indicating the specific salary of each employee.
SECTION 5. The following positions shall be compensated in the year 2024 as follows:

RESOLUTION OF THE TOWNSHIP COMMITTEE EXTENDING TAX GRACE
PERIOD FOR THIRD QUARTER 2024 TAXES
WHEREAS, in accordance with the provisions of N.J.S.A. 54:4-67, which established a ten (10) day grace period following the date upon which real estate property taxes become payable; and
WHEREAS this grace period provides that no interest shall be charged if payment of any installment is made within the tenth calendar day following the date upon which the same became payable; and
WHEREAS, due to delays in the Township’s 2024 Tax Rate being certified by the County of Monmouth of the State of New Jersey, the Township Tax Collector anticipates 2024 Final Property Tax Bills which include the 3rd Quarter payment amount will be mailed as soon as possible; and
WHEREAS N.J.S.A. 54:4-66.3(d) requires that at least 25 days elapse between the time the tax bills are mailed to the date taxes are due; and
NOW THEREFORE BE IT RESOLVED, by the Committee of the Township of Shrewsbury that the Tax Collector be authorized to extend the grace period for the third quarter 2024 up to and including the 25th day after the actual bills are mailed; and
NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township of Shrewsbury, in the County of Monmouth, State of New Jersey, as follows:
1.The grace period for the third quarter 2024 Tax installment for real estate property taxes is hereby extended so that no interest shall be charged if payment of the third quarter Tax installment is made 25 days from mailing date. Payments received after 25 days shall be charged interest from the August 1, 2024, due date.
2.The Township Clerk is hereby directed to forward a certified copy of this Resolution to the Township Tax Collector.
Interpretive Statement: Extension of the grace period may be needed to allow the mandated 25 days prior to payment due date. If payment for the third quarter 2024 is not received by the 25th calendar day after the delivery of the tax bills to the post office, interest will be charged back to the August 1st due date.

ORDINANCE PROVIDING FOR THE CONTROL OF FERAL CATS IN THE TOWNSHIP OF SHREWSBURY, COUNTY OF MONMOUTH AND STATE OF NEW JERSEY
WHEREAS the Mayor and Township Committee of the Township of Shrewsbury are aware of problems in the Township caused by an increasing feral cat population; and
WHEREAS there are no facilities in the Township of Shrewsbury (“Township”) to address issues created by feral cats; and
WHEREAS programs for the managed care of feral cat colonies have proven to be effective in reducing the number of feral cats and is more humane than trapping and euthanizing; and
WHEREAS the Mayor and Township Committee deem it in the public interest to amend the Ordinances in order to permit implementation of a Community Cat Program in Shrewsbury Township for purposes of reducing the population of feral and free- roaming cats, benefitting the public health and improving the quality of life for residents, and insuring the humane treatment of community cats; and
WHEREAS this Ordinance was amended in 2017 for the managed care of feral cat colonies with reference to the necessity of registration of feral cat colonies, a prior Ordinance requiring the licensing and controlling of cats was rescinded on September 20, 2022, and the two actions need to be distinguished.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED, by the Mayor and Township Committee of the Township of Shrewsbury, County of Monmouth and
State of New Jersey that the existing Ordinances concerning the licensing and controlling of cats in Shrewsbury Township shall be amended and supplemented as follows:
Section 1. Definitions.
Cat(s); means every cat, regardless of sex or age. Feral Cat(s) or Community Cat(s); means a cat, regardless of sex or age, that is unowned, free roaming and not interactive with humans. Feral Cat Colony; means a group of feral cats that have been trapped, neutered or spayed and released back into the area from which they were taken. Feral Cat Colony Caretaker; means a person who has registered the colony with the Township of Shrewsbury or any delegated animal control association, and who provides sustenance, water and care for a feral cat colony. Adult Cat(s); means any cat over the age of four (4) months. Nuisance Cat(s); means any cat that unreasonably annoys humans, endangers the life or health of other animals or persons, or substantially interferes with the rights of citizens, other than their owners, to enjoyment of life or property. Owner; means every person having the right of property and a cat(s), or who keeps or harbors a cat(s), or who has a cat(s) in his/her care or who acts as a custodian of a cat(s), or who permits a cat(s) to remain in or about the premises occupied by him/her.
Section 2. Limitations on Keeping Cat(s).
No owner of any cat(s) shall allow the animal to freely roam out of doors; unless it has been spayed or neutered. The owner of each spayed or neutered cat(s) shall keep a record for each cat(s) from a duly licensed veterinarian containing a description of the cat(s), the name of the owner and the date in which the spaying or neutering took place. Any cat(s) allowed to roam out of doors shall be required to wear a collar; designed to release the cat(s) should it become entangled or trapped by the collar, containing the owner’s identification information and proof of current rabies vaccination. It shall be unlawful for any person to own, keep, hold, board or harbor more than five (5) adult cats that are allowed to freely roam out of doors. An adult cat is described as a cat over the age of four (4) months. The limitation on the number of cats owned, kept, held or harbored shall not apply to caretakers of feral cat colonies that have registered such colonies with the Township. Registration shall include the name and address of the caretaker(s), animal rescue group, if any, that they are affiliated with, and the location of the colony. A feral cat colony may be registered when the volunteer caretaker and Shrewsbury Township can assure that: Regular feeding of the colony will be maintained throughout the year; Adult cats and kittens over eight (8) weeks of age that can be captured, will be neutered or spayed and vaccinated against rabies. A three-year rabies vaccine will be administered whenever feasible; Every attempt will be made to remove kittens from the colony before they reach the age of eight (8) weeks for domestication and placement; Sick or injured cats will be removed from the colony for immediate veterinarian care or humane euthanasia; Cats will be earmarked for recognition of members of a registered feral cat colony; and Records of sterilization, vaccination and animal identification can be provided to Shrewsbury Township or its delegated animal control agency, if any, upon request. The breeding of cats for financial gain shall be prohibited. It is acknowledged that the Township of Shrewsbury no longer has a licensing requirement for cats in general, and that registration of feral cat colonies is separate and distinct from any general requirement of licensing, which no longer exists in Shrewsbury Township, and only applies to feral cat colonies to satisfy the conditions of this Ordinance. Section 3. Nuisance Cats.
It shall be unlawful for any person to permit any cat(s) they own, keep, hold, board or harbor to: Damage the property of anyone other than its owner; Enter the property of anyone other than its owner and kill or maim domestic animals or wildlife; Excessively make disturbing noises, including, but not limited to, continued and repeated caterwauling, howling, whining, or other utterances causing unreasonable annoyance, disturbance or discomfort to neighbors or others; Foul the air with odor and thereby cause unreasonable annoyance or discomfort to neighbors or others near to the premises where the cat(s) is kept or harbored; Cause unsanitary conditions in enclosures or surroundings where the cat(s) is kept or harbored; and Be offensive or dangerous to public health, safety and welfare by virtue of number and/or types of cat(s) contained. Section 4. Trapping of Nuisance Cat(s).
The owner of property in which a feral nuisance cat(s) is present may request a live trap from any local animal control agency, which trap and remove the nuisance cat(s). The live trap must be inspected at a minimum of once every twelve (12) hours by the person who requested the trap, and animal control agency providing such trap, or the Township Animal Control Officer contacted immediately upon the trapping of the cat(s). At no time may a trapped animal remain in a live trap more than six (6) hours, and the trapped animal may not be left in an inhuman condition or position such as adverse weather conditions or where it cannot defend itself from other dangerous animals. The traps will not be placed when the Animal Control Officer of the Township will be unavailable to pick it up the next day; i.e. weekends, holidays and when the Township Animal Control Officer will be off duty. Section 5. Trapping of Healthy Community Cats.
Healthy community cats that have been trapped by animal services, in accordance with this Section and may be identified as either being “on the property of the owner” or where the owner can be identified and not strayed (off the property of the owner) shall be immediately returned to the location and owner at which they are found, released to the caregiver or adopted. Prior to being returned to the owner and its location at which it was found or released to a caregiver, healthy community cats may be sterilized, spayed or neutered, and ear tipped while under anesthesia by a licensed veterinarian and vaccinated for rabies. Notwithstanding the foregoing, whenever such a cat is visibly injured or diseased and appears to be suffering, and it reasonably appears that such cat cannot be expeditiously cured and returned to an owner, then animal services, acting in good faith and upon reasonable belief, may either transfer the cat to an accepting humane society or humanely euthanize the cat upon the advice of, and by a licensed veterinarian. Section 6. Penalties.
Any person, firm, corporation, unincorporated association, group, committee or association violating any provision in this Ordinance shall, upon conviction, be subject to a fine not exceeding $2,500.00, a term of imprisonment not exceeding 90 days or a period of community service not exceeding 90 days, or any combination thereof.
BE IT FURTHER ORDAINED AND ENACTED, that this Ordinance shall take effective immediately upon final adoption and publication in the manner prescribed by law.

ORDINANCE AMENDING AN ORDINANCE PROVIDING FOR THE REGISTRATION, LICENSING AND REGULATION OF DOGS IN THE TOWNSHIP OF SHREWSBURY, MONMOUTH COUNTY, NEW JERSEY
WHEREAS, the Township of Shrewsbury has established a number of Ordinances establishing fees for participants in various activities including an Ordinance providing for the registration, licensing and regulation of dogs originally adopted on September 2, 1953, amended in June, 1960; amended again October 8, 1991; amended again in 1996; amended again in 2007 and amended again in 2014; and
WHEREAS, the State of New Jersey has allowed for increased fees and late fees for the registration and licensing of dogs.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED, by the Governing Body of the Township of Shrewsbury, State of New Jersey that the following existing Ordinance shall be amended and supplemented as follows:
SECTION 1 – Said dog license, if paid on or before the thirty-first day of January of each year, shall be $15.00 for neutered dogs and $18.00 for dogs that have not been neutered inclusive of the state fee required. In addition, there shall be a late fee of $7.00. The owner of any dog requesting a duplicate registration tag shall be charged $2.00 for each additional tag.
SECTION 2 - Every person, business, corporation or association that fails to register and pay the license fee set forth more fully in Section 1 of this Ordinance in accordance with the time schedule set forth in Section 1 of this Ordinance, shall pay a late fee of $7.00 for each month that the person, business, corporation or association fails to license or renew its license in accordance with Section 1, and shall pay said late fees upon renewal of the license or as a result of enforcement of this Ordinance.
SECTION 3 - Any violation of Section 1 or 2 of this Ordinance shall lead to enforcement in Municipal Court of Shrewsbury Township or other designated Court having a Shared Service Agreement with a minimum fine of $250.00 for each and every month from the date in which registration and licensing in required if the Defendant has failed to register and pay the License Fee set forth more fully in Sections 1 and 2 of this Ordinance.
BE IT FURTHER ORDAINED, that this Ordinance shall take effective immediately upon final adoption and publication in the manner prescribed by law.
All Ordinances or parts of Ordinances that are inconsistent herewith are repealed, but only to the extent of such inconsistency.

BE IT ORDAINED by the Township Committee of the Township of Shrewsbury, County of Monmouth, State of New Jersey as follows:
WHEREAS the Township of Shrewsbury may make, amend, appeal and enforce such ordinances, regulations, rules and by-laws not contrary to the laws of the State of New Jersey or the United States as it may deem necessary and proper for the good government, order and protection of persons and property and for the preservation, the public health, safety and welfare of the Township of Shrewsbury and its inhabitants and as may be necessary to carry into effect the powers and duties conferred and imposed by the laws of Shrewsbury Township in the County of Monmouth in the State of New Jersey pursuant to N.J.S.A. 40:48-2.

Notice is hereby given that, in accordance with P.L.2015, c.18 (C.58:30-6), after reviewing the proposal submitted by New Jersey American Water for the purchase of the water system, the Township of Shrewsbury has designated New Jersey American Water as the qualified respondent whose proposal was found to be the most advantageous to the public, taking into consideration the evaluation criteria set forth in the request for proposals and as specified under P.L. 2015 c.18 C.58:30-6(b). The proposal submitted by New Jersey American Water was found to be the most advantageous to the public due to the following critical items:
Cash payment for the water assets. A capital improvement plan, including monetary commitment and complete replacement of distribution infrastructure. Transition of responsibility under the Water Quality Accountability Act to New Jersey American Water (NJAW), which will stabilize and improve resiliency of the Township’s aging water infrastructure. Operational and regulatory relief allowing the Township to focus on other priorities and reducing the environmental and financial risk to the Township. Customer financial assistance programs for qualifying customers. Ability to respond to emergency conditions and location of critical staff and regional offices. Commitment to restore roads in the Township including full width mill and overlay in any location where water main will be replaced. WHEREAS, R.S. 54:4-67 permits the governing body of each municipality to fix the rate of interest to be charged for non-payment of taxes or assessments subject to any abatement or discount for the late payment of taxes or assessments as provided by law;
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Township Committee of the Township of Shrewsbury, County of Monmouth, State of New Jersey that property taxes shall be due and payable quarterly on February 1st, May 1st, August 1st and November 1st of each year with a ten-day grace period, after which dates, if unpaid, shall become delinquent with interest charged as set forth below and reverting back to the due date on any quarterly installment of taxes.

BOND ORDINANCE PROVIDING FOR VARIOUS CAPITAL IMPROVEMENT PROJECTS, APPROPRIATING $58,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $55,100 BONDS AND NOTES TO FINANCE A PORTION OF THE COSTS THEREOF, AUTHORIZED IN AND BY THE TOWNSHIP OF SHREWSBURY, IN THE COUNTY OF MONMOUTH, NEW JERSEY
BE IT ORDAINED by the TOWNSHIP COMMITTEE OF THE TOWNSHIP OF SHREWSBURY, IN THE COUNTY OF MONMOUTH, STATE OF NEW JERSEY (not less than two-thirds of all members thereof affirmatively concurring), AS FOLLOWS:
Section 1. The improvements described in Section 3 of this bond ordinance are hereby authorized as general improvements to be undertaken in and by the Township of Shrewsbury, in the County of Monmouth, New Jersey (the “Township”). For the improvements or purposes described in Section 3, there is hereby appropriated the sum of $58,000, said sum being inclusive of all appropriations heretofore made therefor, including the sum of $2,900 as the down payment for said purposes as required by the Local Bond Law, N.J.S.A. 40A:2-1 et seq. The down payment is now available by virtue of provision for down payment or for capital improvement purposes in the Capital Improvement Fund of one or more previously adopted budgets.
Section 2. In order to finance the costs of said improvements or purposes not provided for by the application of the down payment, negotiable bonds are hereby authorized to be issued in the principal amount not to exceed $55,100, pursuant to the Local Bond Law. In anticipation of the issuance of said bonds and to temporarily finance said improvements or purposes, negotiable bond anticipation notes are hereby authorized to be issued pursuant to and within the limitations prescribed by the Local Bond Law.
Section 3.(a) The improvements hereby authorized and the purposes for which the obligations are to be issued consist of improvements to the HVAC system in Township Buildings, acquisition of a Transformer Pole – 26 Barker/46 Belshaw; Park Lighting, and Barker Avenue – Crossarm, together will all purposes necessary, incidental or appurtenant thereto, all as shown on and in accordance with contracts, plans, specifications or requisitions therefore on file with or through the Municipal Clerk, as finally approved by the governing body of the Township.
(b) The estimated maximum amount of bonds or notes to be issued for the improvements or purposes described in Section 3(a) hereof is $55,100, as stated in Section 2 hereof.
(c) The estimated cost of the improvements or purposes described in Section 3(a) hereof is $58,000, which is equal to the amount of the appropriation herein made therefor. The excess of the appropriation of $58,000 over the estimated maximum amount of bonds or notes to be issued therefor being the amount of said $2,900 down payment for said purposes.
Section 4. All bond anticipation notes issued hereunder shall mature at such times as may be determined by the chief financial officer of the Township, provided that no note shall mature later than one (1) year from its date. All notes issued hereunder may be renewed from time to time subject to the provisions of N.J.S.A. 40A:2-8. The notes shall bear interest at such rate or rates and be in such form as may be determined by the chief financial officer, who shall determine all matters in connection with notes issued pursuant to this ordinance, and the chief financial officer's signature upon the notes shall be conclusive evidence as to all such determinations. The chief financial officer is hereby authorized to sell part or all of the notes from time to time at public or private sale and to deliver them to the purchasers thereof upon receipt of payment of the purchase price plus accrued interest from their dates to the date of delivery thereof. The chief financial officer is directed to report in writing to the governing body at the meeting next succeeding the date when any sale or delivery of such notes occurs, such report shall include the amount, the description, the interest rate and the maturity schedule of the notes sold, the price obtained and the name of the purchaser.
Section 5. The following additional matters are hereby determined, declared, recited and stated:
(a) The improvements or purposes described in Section 3 of this bond ordinance are not a current expense and are improvements or purposes that the Township may lawfully undertake as general improvements, and no part of the cost thereof has been or shall be specially assessed on property specially benefited thereby.
(b) The average period of usefulness of the improvements or purposes, within the limitations of the Local Bond Law and taking into consideration the amount of the obligations authorized for said purposes, according to the reasonable life thereof computed from the date of the bonds authorized by this bond ordinance, is ten (10) years.
(c) The Supplemental Debt Statement required by the Local Bond Law has been duly prepared and filed in the office of the Municipal Clerk, and a complete executed duplicate thereof has been filed in the office of the Director of the Division of Local Government Services in the Department of Community Affairs of the State of New Jersey. Such Statement shows that the gross debt of the Township as defined in the Local Bond Law is increased by the authorization of the bonds and notes provided in this bond ordinance by $55,100 and the obligations authorized herein will be within all debt limitations prescribed by that Law.
(d) An aggregate amount not exceeding $5,000 for interest on said obligations, costs of issuing said obligations, engineering costs, legal fees and other items of expense listed in and permitted under N.J.S.A. 40A:2-20 is included as part of the cost of said improvements and is included in the estimated cost indicated herein for said improvements.
(e) To the extent that moneys of the Township are used to finance, on an interim basis, costs of said improvements or purposes, the Township reasonably expects such costs to be paid or reimbursed with the proceeds of obligations issued pursuant hereto.
Section 6. The capital budget of the Township is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency herewith. The resolution in the form promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director of the Division of Local Government Services is on file with the Municipal Clerk and is available there for public inspection.
Section 7. Any grant or similar moneys from time to time received by the Township for the improvements or purposes described in Section 3 hereof, shall be applied either to direct payment of the cost of the improvements within the appropriation herein authorized or to payment of the obligations issued pursuant to this ordinance. The amount of obligations authorized but not issued hereunder shall be reduced to the extent that such funds are received and so used.
Section 8. The full faith and credit of the Township are hereby pledged to the punctual payment of the principal of and the interest on the obligations authorized by this bond ordinance. The obligations shall be direct, unlimited obligations of the Township, and, unless paid from other sources, the Township shall be obligated to levy ad valorem taxes upon all the taxable property within the Township for the payment of the obligations and the interest thereon without limitation as to rate or amount.
Section 9. This bond ordinance shall take effect twenty (20) days after the first publication thereof after final adoption, as provided by the Local Bond Law.

ORDINANCE AMENDING THE PERSONNEL HANDBOOK AND PERSONNEL CODE PREVIOUSLY ADOPTED
WHEREAS, the Mayor and Township Committee adopted an Ordinance establishing a Personnel code on February 28, 2006; and
WHEREAS, the Mayor and Township Committee of the Township of Shrewsbury adopted a new Personnel Code, making reference to and replacing the Code with a Personnel Handbook on October 23, 2018; as amended on May 14, 2019.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED, by the Mayor and Township Committee of the Township of Shrewsbury, County of Monmouth and State of New Jersey that all Personnel Policies shall be replaced by an amended Personnel Handbook adopted by Ordinance and maintained by Resolution or Ordinance at the discretion of the governing body. Said Personnel Handbook shall be available in the Clerk’s Office of Shrewsbury Township.
BE IT FURTHER ORDAINED AND ENACTED, that this ordinance shall take effective immediately upon final adoption and publication in the manner prescribed by law.

AUTHORIZE DEED OF OPEN SPACE EASEMENT
WITH THE COUNTY OF MONMOUTH
WHEREAS, This EASEMENT made this 25TH day of October 2023 between the Township of Shrewsbury, located at 1979 Crawford Street Shrewsbury Township, New Jersey 07724 (hereinafter referred to as "MUNICIPALITY"), and the COUNTY OF MONMOUTH, located in the Hall of Records, 1 East Main Street, Freehold, New Jersey, 07728 (hereinafter referred to as "COUNTY").
WITNESSETH:
WHEREAS, the MUNICIPALITY is the sole owner in fee simple of a tract of land in Shrewsbury Township, Monmouth County, State of New Jersey, more particularly described as Block 2, Lot 4 encompassing 2.22 acres on the tax map of Shrewsbury Township, Monmouth County, New Jersey (hereinafter referred to as the "Property"); and more particularly described in the tax map attached as Exhibit A attached hereto and made a part hereof; and
WHEREAS the Property possesses park, recreation, and open space values of great importance to the people of the County of Monmouth; and
WHEREAS the MUNICIPALITY agrees that the park, recreation, and open space values of the Property be preserved in perpetuity; and
WHEREAS, the MUNICIPALITY further agrees, as owner of the Property, to convey to the COUNTY the open space easement herein described to preserve and protect the park, recreation, and open space values of the Property in perpetuity; and
WHEREAS the COUNTY is a body politic and corporate of the State of New Jersey empowered pursuant to N.J.S.A. 40:32-2.1 to acquire interests in land and hold same for public park, public recreation and public welfare purposes; and
WHEREAS, the COUNTY has made a financial investment in the Property through the Monmouth County Municipal Open Space Grant Program by providing the MUNICIPALITY with a grant of $115,000 (#20-14), for the development of the Property.
NOW, THEREFORE, in recognition of the foregoing and in consideration of the Municipal Open Space Grant made to the MUNICIPALITY, the MUNICIPALITY does hereby grant and convey to the COUNTY an easement over, under and right in perpetuity to restrict as set forth herein the use of the real property designated as Block 2, Lot 4 encompassing 2.22 acres on the tax map of the Township of Shrewsbury, Monmouth County, New Jersey.
1. PURPOSE. It is the purpose of this Easement to guarantee that the Property will be retained forever for public park, recreation and open space uses and to prevent any use of the Property that will significantly impair or interfere with the park, recreation, and open space values of the Property.
TRUST. The property shall be held in trust in perpetuity and used exclusively for the purposes authorized by the Open Space and Farmland Preservation, Recreation, Conservation and Historical Preservation Act as may be amended from time to time [NJSA 40:12-15.6b].
PUBLIC ACCESS. The MUNICIPALITY agrees to make the open space accessible to the public, unless the MUNICIPALITY and COUNTY determines that public accessibility would be detrimental to the lands, waters, or improvements thereon, or to any natural resources associated therewith [NJSA 40:12-15.6D (3)].
OPEN SPACE INVENTORY. The MUNICIPALITY shall cause the funded property to be listed in the Municipal Recreation and Open Space Inventory at the time it is filed with the New Jersey Green Acres Program or its successors.
RIGHT OF COUNTY. To accomplish the purpose of this easement, the following rights are conveyed to the COUNTY by this easement:
A. To preserve and protect the park, recreation, and open space values of the Property.
B. To prevent any activity on or use of the Property that is inconsistent with the purpose of this easement and to require the restoration of such areas or features of the Property that may be damaged by an inconsistent use or activity.
The COUNTY and its agents, representatives, servants or assigns, shall be permitted to enter upon the Property at all reasonable times, after giving prior reasonable notice, in order to monitor compliance with and otherwise enforce the terms of the Easement, provided that COUNTY, its agents, etc. shall not unreasonably interfere with use and quiet enjoyment of the Property.
The MUNICIPALITY agrees not to lease, sell, exchange or donate the Property described herein which is being acquired pursuant to P.L. 1997 c. 24, NJSA 40:12-15.6(A) except upon approval of the Monmouth County Board of Chosen Freeholders and upon such conditions as the Monmouth County Board of Chosen Freeholders may establish [NJSA 40:12-15.6(d)(4)] including, but not limited to, replacement with land of no less or greater utility, acreage and value.
PROHIBITED USES. Any activity on or use of the Property inconsistent with the purpose of this easement is prohibited.
7. GREEN ACRES RESTRICTIONS. If the lands being conveyed herein were purchased in part with Green Acres funding, they are subject to Green Acres restrictions as provided in N.J.S.A. 13:8C-1 et seq. and N.J.A.C. 7:36.
8. RESERVED RIGHTS. The MUNICIPALITY reserves to itself and to its personal representatives, heirs, successors and assigns, all rights accruing from its ownership of the Property, including the right to engage in or permit or invite others to engage in all uses of the Property that are not inconsistent with this easement.
9. GRANTEE’S REMEDIES. If the COUNTY determines that the MUNICIPALITY is in violation of the terms of this easement or that a violation is threatened, the COUNTY shall give written notice to the MUNICIPALITY of such violation and demand corrective action sufficient to cure the violation and, where the violation involves injury to the Property resulting from any use or activity inconsistent with the purpose of this easement, to restore the portion of the Property so injured. If the MUNICIPALITY or its assigns fail to correct the violation within sixty days after receipt of notice thereof from the COUNTY or under circumstances where the violation cannot be cured within the sixty day period or fails to diligently pursue curing such violation until finally cured, the COUNTY may bring an action at law or in equity in a court of competent jurisdiction to enforce the terms of this easement, to enjoin the violation ex parte as necessary, by temporary or permanent injunction, to recover any damages to which it may be entitled for violation of the term of this easement or injury to any park, recreation or open space values protected by this easement; to require the restoration of the Property to the condition that existed prior to such injury; and all costs and expenses, including reasonable attorney’s fees incurred in enforcing the COUNTY’s rights herein.
10. COUNTY'S DISCRETION. Enforcement of the terms of this easement shall be at the discretion of the COUNTY, and any forbearance by the COUNTY to exercise its rights under this easement in the event of any breach of any terms of this easement by the MUNICIPALITY shall not be deemed or construed to be a waiver by the COUNTY of such terms or any subsequent breach of the same or any other term of this easement or of any of the COUNTY’S rights under this easement. No delay or omission by the COUNTY in the exercise of any right or remedy upon any breach by the MUNICIPALITY shall impair such right or remedy or be construed as a waiver.
11. SURVIVAL. The terms of an Agreement between the MUNICIPALITY and the COUNTY dated May 19, 2021 (#20-14) shall survive the delivery of this Deed of Open Space Easement and the terms of which Agreement are incorporated herein by reference.
12. WAIVER OF CERTAIN DEFENSES. The MUNICIPALITY hereby waives any defense of laches, estoppel or prescription.
13. ACTS BEYOND CONTROL. Nothing contained in this easement shall be construed to entitle the COUNTY to bring any action against the MUNICIPALITY for any injury or change in the Property resulting from causes beyond the MUNICIPALITY’S control including, without limitation, fire, flood storm and earth movement, or from any prudent action taken by the MUNICIPALITY under emergency conditions to prevent, abate or mitigate injury to the Property resulting from said causes.
14. COSTS AND LIABILITIES. The MUNICIPALITY shall retain all responsibilities and shall bear all cost and liabilities of any kind related to the ownership, operation, upkeep, and maintenance of the Property, including the maintenance of adequate comprehensive general liability insurance coverage. The MUNICIPALITY shall keep the Property free of any liens arising out of any work performed, for material furnished to or obligations incurred by the MUNICIPALITY.
15. RISK OF LOSS. Risk of loss or damage to the Property by fire or another casualty shall be, and is assumed, by the MUNCIPALITY. The MUNICIPALITY is required to advise the COUNTY of any occurrence which results in loss of or damage to any improvements funded by the COUNTY or which results in the impairment of the Property’s Park, recreation and open space use.
16. COVENANTS. The MUNICIPALITY covenants with the COUNTY as follows:
(a) The MUNICIPALITY is seized of said easement and has good right and title to convey same;
(b) The COUNTY shall quietly enjoy the said easement.
(c) The MUNICIPALITY shall have quiet possession of the easement free from all encumbrances.
17. SUCCESSOR. The covenants, terms, conditions, and restrictions of this easement shall be binding upon and inure to the benefit of the parties hereto and their respective personal representatives, heirs, successors and assigns, and shall continue as a servitude running in perpetuity with the Property.

NOTICE OF APPROVAL
Notice is hereby given that, in accordance with N.J.S.A. 58: 30-5.b and e, the NJDEP has approved the Township of Shrewsbury’s certification as to the existence of Emergent Condition No. 4 of the WIPA, which states that there is a demonstrated lack of historical investment, repair, or sustainable maintenance, or material damage to the infrastructure of the system. The emergent condition certification is in anticipation of the sale of the Township’s water assets to a capable private or public entity. A petition may be filed within 45 days of the publication of this notice to require a referendum before a resolution authorizing the sale of the Townships water assets may take effect.

“Notice is Hereby given that the Township of Shrewsbury desires to sell their water system under the Water Infrastructure Protection Act (WIPA). It has been determined that under Emergent Conditions #4 of WIPA there is a demonstrated lack of historical investment, repair, or sustainable maintenance, or material damage to the infrastructure of the system. In addition, under Emergent Condition #5, the Township of Shrewsbury lacks the financial, technical, or managerial capacity to address any of the forgoing on a sustainable basis or own and operate the system in a way that supports economic activity in the municipality on a sustainable basis. The certification of these emergent conditions is based on the Township’s lack of licensed operators, maintenance, and record keeping; watermain breaks and leaks, service line breaks; and a need for investment and watermain replacement. The Asset Valuation Assessment found that any sale of the facilities would produce an economic and and/or economic benefit to the Township. Reports have been prepared and will be presented and document the findings at the Township’s June 13, 2023 Special meeting at 6:00 pm at the Municipal Building of Shrewsbury Township, 1979 Crawford Street, Shrewsbury Township, New Jersey. The Township intends to approve this report as a certification in anticipation of a proposed long-term lease or sale of water or wastewater assets to a capable private or public entity.”

NOTICE TO BIDDERS
ON RECYCLING CONTRACT
NOTICE is hereby given that sealed bids will be received and opened and read by the Township Committee of the Township of Shrewsbury, Monmouth County, New Jersey at a regular meeting of the Township Committee at the Municipal Complex, 1979 Crawford Street, Shrewsbury Township on April 11, 2023 at 6PM for the collection, removal and disposal of recyclable materials in the Township of Shrewsbury, for a period of one year beginning June 1, 2023 and ending May 31, 2024, with alternative plans for options to renew as provided in the specifications. Said service is to be rendered in accordance with the specifications in proposal form which is on file at the Township office of the Township Clerk and may be inspected by prospective bidders during business hours Monday through Thursday.
All bids must be received by 5:59pm on April 11, 2023. Bids must be enclosed in a sealed envelope addressed to the “Municipal Clerk” and clearly marked on the outside “Bid For Recycling Contract – Shrewsbury Township”
Bidders will be furnished with a copy of the contract documents and specifications by request upon proper notice and payment of a non-refundable charge of $75.00 payable to Shrewsbury Township to defray the costs thereof. The proposals must be made in the standard proposal form in the manner designated in the contract documents, must be enclosed in a sealed envelope bearing the name and address of the bidder and that is set forth more fully above and must be accompanied by a statement of Consent of Surety from a surety company authorized to do business in the State of New Jersey and acceptable to the Township and either a Bid Bond or a certified check drawn to the order of the Treasurer of the Township of Shrewsbury for not less than 10% of the amount bid, except that the check shall not exceed $20,000.00. The successful bidder is hereby notified that a performance bond for the full amount of this project is required. The check or bond of the unsuccessful bidder will be returned with 5 days after the contract has been entered into and the bond furnished. In the event that the successful bidder refuses to enter into the contract or fails to furnish the necessary bond, the amount of the successful bidders check or bid will be forfeited.
The Township is not responsible for loss or destruction of any bids mailed or delivered to the Township Clerk prior to the time set forth for bid opening.
The award of the contract for this project will not be made until the necessary funds have been provided by the Township of Shrewsbury in a lawful manner.
Proposals for the contract will only be accepted from bidders who have properly qualified in accordance with the requirements of the contract documents.
The right is also reserved to reject any and all bids or to waive any information where such informality is not detrimental to the best interest of the Township.
The successful bidder shall be required to comply with the following:
Certified photo-copies of bidder’s certificate of public convenience and necessity and an approval letter issued in conformance with N.J.S.A. 13:1E-126; Statement and Questions setting forth experience and qualifications; Bid Guarantee in the form of a bid bond, certified check or cashier’s checks in the amount of 10% of the total amount of the bid proposal, not to exceed $20,000; payable to Shrewsbury Township; Non-conclusion affidavit; Stockholder statement of ownership; Listing of subcontractors; Certificate of surety; and Bid proposal Certified photocopy of Bidder’s New Jersey State Business Registration Certificate; Certified photocopy of Certificate of Employee Information Report; Affirmative Action Compliance, Mandatory Affirmative Action Language; Mandatory Language – American with Disabilities Act; Disclosure of Investment Activities in Iran.

The right is also reserved to reject any or all bids or to waive any informalities where such informality is not detrimental to the best interest of the Owner, except as to those items which are deemed mandatory and non-waivable set forth in N.J.S.A. 40A:11-23.2. Further, the Owner reserves the right to abandon the project and reject the bids entirely if any legal or state or federal administrative action is taken against the Owner which could delay or jeopardize the project from commencing. Designate Regular Meeting Schedule for the 2022 Year
WHEREAS, Public Law 1975, Chapter 231, Section 13, requires a public body to post and maintain posted, to distribute to designated newspapers, and to further file with the Municipal Clerk for the purpose of public inspections, a schedule of the regular meetings of such public body to be held during the calendar year; and,
WHEREAS, such schedule of regular meetings is required to contain the location of each meeting, to the extent that it is known, and the time and date of each meeting; and,
WHEREAS, Public Law 1975, Chapter 231, Section 3.D, provides that where the
annual notice or revisions thereof, in compliance with sections of the subject act, set forth the location, time and date of any meeting, no further action shall be required for such meeting.
NOW THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Shrewsbury, County of Monmouth, State of New Jersey as follows:

Submissions by Corporations and Partnerships shall include a completed Disclosure of Ownership form (N.J.S.A. 52:25-24.2) and shall include a completed Non-Collusion Affidavit.
The Township Committee reserves the right to reject any and all submissions due to any defects or waive informalities and accept any submissions that in their judgment will be in the best interest of the Township. Notice to Bidders
Notice is hereby given that sealed proposals will be received by the Mayor and Committee of the Township of Shrewsbury, Monmouth County, New Jersey for Barker Avenue Roadway Improvements – Phase I and be opened and read in public in the gymnasium of Town Hall, 1979 Crawford Street, Shrewsbury, New Jersey, on November 10, 2021 at 11:00 am. prevailing time. Please be advised that masks and social distance are required.
All work on this contract shall be completed within Forty-Five (45) calendar days.
The scope of work of this contract includes roadway rehabilitation, drainage improvements, replacement and installation of curb and sidewalk for Barker Avenue.
Contract Documents and Drawings for the proposed work, which have been prepared by the Township Engineer, William HR White III, P.E., P.P., C.M.E., of the firm of Colliers Engineering & Design., are available at the office of said Engineer at 331 Newman Springs Road, Suite 203, Red Bank, New Jersey, and may be inspected by prospective bidders during business hours.
Bidders will be furnished with a copy of the Contract Documents by request upon proper notice and payment of a non-refundable charge of One Hundred and Fifty dollars ($150.00) payable to Colliers Engineering & Design. to defray the cost thereof. Proposals must be made on the standard Proposal Forms in the manner designated in the Contract Documents, must be enclosed in sealed envelopes bearing the name and address of the Bidder, and the name of the work on the outside; addressed to Mayor and Committee, Township of Shrewsbury; and must be accompanied by a statement of Consent of Surety from a surety company authorized to do business in the State of New Jersey and acceptable to the Township and either a Bid Bond or a Certified Check drawn to the order of Treasurer of the Township of Shrewsbury for not less than ten percent (10%) of the amount bid, except that the check need not exceed $20,000.00. The successful bidder is hereby notified that a performance bond for the full amount of the project is required.
The award of the contract for this project will not be made until the necessary funds have been provided by the Township of Shrewsbury in a lawful manner.
The Township of Shrewsbury or the Engineer reserves the right to require a complete financial and experience statement from prospective bidders showing that they have satisfactorily completed work of the nature required before furnishing proposal forms or specifications, or before awarding the Contract.
Proposals for this Contract will be accepted only from bidders who have properly qualified in accordance with the requirements of the Contract Documents.
The right is also reserved to reject any or all bids or to waive any informalities where such informality is not detrimental to the best interest of the Township of Shrewsbury. The right is also reserved to increase or decrease the quantities specified in the manner designated in the Specifications.
The successful bidder shall be required to comply with the following:

ORDINANCE ADOPTING MITIGATION PLAN ADOPTED BY THE MONMOUTH COUNTY OFFICE OF EMERGENCY MANAGEMENT WITH MICHAEL BAKER INTERNATIONAL, INC.
WHEREAS, the Township of Shrewsbury has in the past experienced natural hazards that result in public safety hazards and damages to private and public property; and
WHEREAS, a Hazard Mitigation Planning Process by the State of New Jersey and the Federal Emergency Management Agency Office set forth an opportunity to consider national hazards and risks, and to identify mitigation actions to reduce future risks; and
WHEREAS, the New Jersey Office of Emergency Management has provided Federal Mitigation Funds to support development of an updated Mitigation Plan; and
WHEREAS, Thomas Welsh is the Emergency Management Officer for the Township of Shrewsbury, and as so, Mr. Welsh has recommended the Township adopt a Mitigation Plan, entitled, “Monmouth County Multi-jurisdictional All Hazards Mitigation Plan” updated by the Monmouth County Office of Emergency Management, who contracted with Michael Baker International, Inc. in developing the plan; and
WHEREAS, the Mitigation Plan received FEMA approval pending adoption status on August 27, 2020; and
WHEREAS, it is in the best interest of the residents of the Township of Shrewsbury to have an Emergency Management Mitigation Plan to address emergency management situations.
NOW THEREFORE BE IT ORDAINED, by the governing body of the Township of Shrewsbury in the County of Monmouth and the State of New Jersey, that the governing body hereby adopts and accepts the Monmouth County Multi-jurisdictional All-hazards Mitigation Plan (“Mitigation Plan”) accepted by the Monmouth County Office of Emergency Management through a contract with Michael Baker International, Inc., and updated as of August 27, 2020.
BE IT FURTHER ORDAINED, that the Township of Shrewsbury’s Departments, identified in the Plan are hereby directed to further pursue potential or further implementation of the recommended Plan priority activities that are assigned to their departments.
BE IT FURTHER ORDAINED, that any action proposed by the Plan shall be subject to and contingent upon budget approval, if required, which shall be at the discretion at the Township of Shrewsbury, and this Ordinance shall not be interpreted so as to mandate any other appropriation.
BE IT FURTHER ORDAINED, that the Township of Shrewsbury Emergency Management Coordinator, Thomas Welsh, is designated to coordinate with other offices and shall periodically report on the activities, accomplishments and progress, and shall prepare an annual progress report to be submitted to the New Jersey Office of Emergency Management. Said status report shall be submitted on a yearly bases with a predetermined date agreed upon by all stakeholders.
BE IT FURTHER ORDAINED, that a USB flash drive of the full Mitigation Plan is available at the Monmouth County Emergency Management Office, as well as in the Clerk’s Office of Shrewsbury Township for review.
BE IT FURTHER ORDAINED, that a copy of this Ordinance, once adopted, shall be forwarded to Michael Yaffe, Senior Associate of Michael Baker International, Inc. at 300 American Metro Blvd., Ste. 154, Hamilton, New Jersey 08619, and to the Monmouth County Office of Emergency Management, and a copy shall also be provided to the Emergency Management Officer of Shrewsbury Township, Thomas Welsh.
BE IT FURTHER ORDAINED, that this Ordinance shall take effect immediately upon final adoption and publication in the manner prescribed by law.
BE IT FURTHER ORDAINED, that all Ordinances or parts of Ordinances that are inconsistent herewith are repealed, but only to the extent of such inconsistency.

PUBLIC HEARING NOTICE
TAKE NOTICE that the Township of Shrewsbury, Monmouth County, New Jersey is considering filing grant applications to the NJDEP Green Acres Program Local Government Assistance grant and loan. The grant application and proposed projects will be discussed during a public hearing. The project under consideration will include development of new playground equipment, picnic tables and benches, fencing and ADA compliant paths and equipment at Eloise Nagel Park.
The public is invited to attend and comment on these potential projects and other recommendations for park development within the Township.

WHEREAS, the TOWNSHIP Council of the TOWNSHIP of Shrewsbury, in the County of Monmouth, New Jersey (the “TOWNSHIP”) has determined to IMPROVEMENTS TO PARK; and
WHEREAS, the TOWNSHIP has $115,000 in the Capital Improvement Fund and $115,000 from The County of Monmouth Open Space Grant.
NOW, THEREFORE, BE IT ORDAINED by the TOWNSHIP COMMITTEE OF THE TOWNSHIP OF SHREWSBURY, IN THE COUNTY OF MONMOUTH, STATE OF NEW JERSEY, AS FOLLOWS:
Section 1. The improvements described in Section 2 of this ordinance are hereby authorized as general capital improvements to be undertaken in and by the TOWNSHIP of Shrewsbury, in the County of Monmouth, New Jersey (the “TOWNSHIP”). For the improvements or purposes described in Section 2, there is hereby appropriated $230,000, said sum being inclusive of $115,000 from the Capital Fund Balance and $115,000 from The County of Monmouth Open Space Grant.
Section 2. The purchase hereby authorized to be undertaken is for the IMPROVEMENTS TO PARK together with all purposes necessary, incidental or appurtenant thereto, all as shown on and in accordance with contracts, plans, specifications or requisitions therefor on file with or through the TOWNSHIP Clerk, as finally approved by the governing body of the TOWNSHIP.
Section 3. The 2021 capital budget of the TOWNSHIP will conform with the provisions of this ordinance to the extent of any inconsistency herewith. The resolution in the form promulgated by the Local Finance Board showing full detail of the capital budget and capital program as approved by the Director of the Division of Local Government Services is on file with the TOWNSHIP Clerk and is available there for public inspection.
Section 4. The TOWNSHIP Attorney and other TOWNSHIP officials and representatives are hereby authorized to do all things necessary to accomplish the purposes of the appropriation made herein.
Section 5. This ordinance shall take effect as provided by law.

BOND ORDINANCE PROVIDING FOR IMPROVEMENTS TO BARKER AVENUE AND APPROPRIATING $180,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $70,000 BONDS AND NOTES TO FINANCE A PORTION OF THE COSTS THEREOF, AUTHORIZED IN AND BY THE TOWNSHIP OF SHREWSBURY, IN THE COUNTY OF MONMOUTH, NEW JERSEY
Section 1. The improvements described in Section 3 of this bond ordinance are hereby authorized as general improvements to be undertaken in and by the TOWNSHIP of Shrewsbury, in the County of Monmouth, New Jersey (the “TOWNSHIP”). For the said improvements stated in Section 3, there is hereby appropriated the aggregate sum of $180,000, which sum includes a $100,000 New Jersey Department of Transportation Grant (the “Grant”) and the sum of $10,000 from the Capital Improvement Fund. Pursuant to the Local Bond Law, N.J.S.A. 40A:2-1 et seq. (the “Local Bond Law”), specifically, N.J.S.A. 40A:2-11(c), as amended and supplemented, no down payment is required for the improvements and purposes set forth in Section 3, hereof, as such project is being partially funded by the Grant.
Section 1. For the financing of said improvements and purposes described in Section 3 hereof, negotiable bonds of the TOWNSHIP are hereby authorized to be issued in the principal amount of $70,000 pursuant to the Local Bond Law. In anticipation of the issuance of said bonds and to temporarily finance said improvements or purposes, negotiable notes of the TOWNSHIP in a principal amount not exceeding $70,000 are hereby authorized to be issued pursuant to and within the limitations prescribed by said Local Bond Law.
Section 3. (a) The improvements hereby authorized to be undertaken consist of Improvements to BARKER AVENUE, together with all purposes necessary, incidental or appurtenant thereto, all as shown on and in accordance with plans, specifications or requisitions therefor on file with or through the TOWNSHIP Chief Financial Officer, as finally approved by the governing body of the TOWNSHIP.
(b) The estimated maximum amount of bonds or notes to be issued for the improvements or purposes described in Section 3(a) hereof is $70,000, as stated in Section 2 hereof.
(c) The estimated cost of the improvements or purposes described in Section 3(a) hereof is $180,000, which is equal to the amount of the appropriation herein made therefor. The excess of the appropriation of $180,000 over the estimated maximum amount of bonds or notes to be issued therefor being the amount of said $10,000 from the capital improvement fund and $100,000 from the New Jersey Department of Transportation Grant for said purposes.
Section 4. All bond anticipation notes issued hereunder shall mature at such times as may be determined by the chief financial officer of the TOWNSHIP, provided that no note shall mature later than one (1) year from its date. All notes issued hereunder may be renewed from time to time subject to the provisions of N.J.S.A. 40A:2-8. The notes shall bear interest at such rate or rates and be in such form as may be determined by the chief financial officer, who shall determine all matters in connection with notes issued pursuant to this ordinance, and the chief financial officer's signature upon the notes shall be conclusive evidence as to all such determinations. The chief financial officer is hereby authorized to sell part or all of the notes from time to time at public or private sale and to deliver them to the purchasers thereof upon receipt of payment of the purchase price plus accrued interest from their dates to the date of delivery thereof. The chief financial officer is directed to report in writing to the governing body at the meeting next succeeding the date when any sale or delivery of such notes occurs, such report shall include the amount, the description, the interest rate and the maturity schedule of the notes sold, the price obtained and the name of the purchaser.
Section 5. The following additional matters are hereby determined, declared, recited and stated:
(a) The improvements or purposes described in Section 3 of this bond ordinance are not a current expense and are improvements or purposes that the TOWNSHIP may lawfully undertake as a general improvement, and no part of the cost thereof has been or shall be specially assessed on property specially benefited thereby.
(b) The average period of usefulness of the improvements or purposes, within the limitations of the Local Bond Law and taking into consideration the amount of the obligations authorized for said purposes, according to the reasonable life thereof computed from the date of the bonds authorized by this bond ordinance, is (twenty) 20 years.
(c) The Supplemental Debt Statement required by the Local Bond Law has been duly prepared and filed in the office of the TOWNSHIP Clerk, and a complete executed duplicate thereof has been filed in the office of the Director of the Division of Local Government Services in the Department of Community Affairs of the State of New Jersey. Such Statement shows that the gross debt of the TOWNSHIP as defined in the Local Bond Law is increased by the authorization of the bonds and notes provided in this bond ordinance by $70,000 and the obligations authorized herein will be within all debt limitations prescribed by that Law.
(d) An aggregate amount not exceeding $30,000 for interest on said obligations, costs of issuing said obligations, engineering costs, legal fees and other items of expense listed in and permitted under N.J.S.A. 40A:2-20 is included as part of the cost of said improvements and is included in the estimated cost indicated herein for said improvements.
(e) To the extent that moneys of the TOWNSHIP are used to finance, on an interim basis, costs of said improvements or purposes, the TOWNSHIP reasonably expects such costs to be paid or reimbursed with the proceeds of obligations issued pursuant hereto. This ordinance shall constitute a declaration of official intent for the purposes and within the meaning of Section 1.150-2(e) of the United States Treasury Regulations.
Section 6. The capital budget of the TOWNSHIP is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency herewith. Section 8. The full faith and credit of the TOWNSHIP are hereby pledged to the punctual payment of the principal of and the interest on the obligations authorized by this bond ordinance. The obligations shall be direct, unlimited obligations of the TOWNSHIP, and, unless paid from other sources, the TOWNSHIP shall be obligated to levy ad valorem taxes upon all the taxable property within the TOWNSHIP for the payment of the obligations and the interest thereon without limitation as to rate or amount.
Section 9. This bond ordinance shall take effect twenty (20) days after the first publication thereof after final adoption, as provided by the Local Bond Law.

BE IT ORDAINED by the TOWNSHIP COUNCIL OF THE TOWNSHIP OF SHREWSBURY, IN THE COUNTY OF MONMOUTH, STATE OF NEW JERSEY (not less than two-thirds of all members thereof affirmatively concurring), AS FOLLOWS:
Section 1. The improvements described in Section 3 of this bond ordinance are hereby authorized as general improvements to be undertaken in and by the TOWNSHIP of Shrewsbury, in the County of Monmouth, New Jersey (the “TOWNSHIP”). For the improvements or purposes described in Section 3, there is hereby appropriated the sum of $83,600.00, said sum being inclusive of all appropriations heretofore made therefor and $4,400 as the down payment for said purposes as required by the Local Bond Law, N.J.S.A. 40A:2-1 et seq. The down payment is now available by virtue of provision for down payment or for capital improvement purposes in the Capital Improvement Fund of one or more previously adopted budgets
Section 2. In order to finance the costs of said improvements or purposes not provided for by the application of the down payment and reserve for insurance proceeds, negotiable bonds are hereby authorized to be issued in the principal amount not to exceed $83,600.00, pursuant to the Local Bond Law. In anticipation of the issuance of said bonds and to temporarily finance said improvements or purposes, negotiable bond anticipation notes are hereby authorized to be issued pursuant to and within the limitations prescribed by the Local Bond Law.
Section 3. (a) The improvements hereby authorized to be undertaken consist of the IMPROVEMENTS TO WATER INFRASTRUCTURE, together with all purposes necessary, incidental or appurtenant thereto, all as shown on and in accordance with plans, specifications or requisitions therefor on file with or through the TOWNSHIP Chief Financial Officer, as finally approved by the governing body of the TOWNSHIP.
(b) The estimated maximum amount of bonds or notes to be issued for the improvements or purposes described in Section 3(a) hereof is $83,600.00, as stated in Section 2 hereof.
(c) The estimated cost of the improvements or purposes described in Section 3(a) hereof is $88,000.00, which is equal to the amount of the appropriation herein made therefor. The excess of the appropriation of $88,000.00 over the estimated maximum amount of bonds or notes to be issued therefor being the amount of said $4,400 down payment from grants in aid and other funds.
Section 4. All bond anticipation notes issued hereunder shall mature at such times as may be determined by the chief financial officer of the TOWNSHIP, provided that no note shall mature later than one (1) year from its date. BE IT ORDAINED, by the Township Committee of the Township of Shrewsbury in the
County of Monmouth and State of New Jersey:
SECTION 1. The offices and positions under the Municipal Government of the Township of Shrewsbury shall be compensated at the amount fixed in this Ordinance.
SECTION 2. The Township Chief Financial Officer is hereby authorized to transfer such sums of money from the Municipal Current Account and other such accounts that may cover periodic payrolls in the amounts fixed by this Ordinance.
SECTION 3. Effective January 1, 2021 all employees, eligible for health insurance shall make a contribution of salary towards health benefits based on the annual premium for all health care and prescription premiums as set forth in the schedule promulgated by the NJ Division of Pensions and Benefits herein attached and as revised from time to time. The minimum contribution shall be equal to 1.5% of the employee’s salary.
SECTION 4. The following listed positions are assigned to the following titles with annual salary ranges, providing for minimum and maximum salaries, contingent on merit, the availability of funds, and other provisions of this Ordinance. The Township Committee shall pass an annual resolution indicating the specific salary of each employee.

AN ORDINANCE TO EXCEED THE CALENDAR YEAR 2021
MUNICIPAL BUDGET APPROPRIATION LIMITS AND
TO ESTABLISH A CAP BANK
(N.J.S.A. 40A:4-45.14)
BE IT ORDAINED by the Township Committee of the Township of Shrewsbury as follows:
WHEREAS, the Local Government Cap Law, N.J.S.A. 40A:4-45.1, et seq., provides that in the preparation of its annual budget, a municipality shall limit any increase in said budget to 1% unless authorized by ordinance to increase it to 3.5% over the previous year’s final appropriations, subject to certain exceptions; and,
WHEREAS, N.J.S.A. 40A:4-45.15a provides that a municipality may, when authorized by ordinance, appropriate the difference between the amount of its actual final appropriation and the 3.5% percentage rate as an exception to its final appropriations in either of the next two succeeding years; and,
WHEREAS, the Township Committee of the Township of Shrewsbury in the County of Monmouth finds it advisable and necessary to increase its CY 2021 budget by up to 3.5% over the previous year’s final appropriations, in the interest of promoting the health, safety and welfare of its citizens; and,
WHEREAS, the Township Committee hereby determines that a 3.5% increase in the budget for the said year, amounting to $21,233.52 in excess of the increase in final appropriations otherwise permitted by the Local Government Cap Law, is advisable and necessary; and,
WHEREAS, the Township Committee hereby determines that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years.
NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Shrewsbury, in the County of Monmouth, a majority of the full authorized membership of this Township Committee affirmatively concurring, that, in the CY 2021 budget year, the final appropriations of the Township of Shrewsbury shall, in accordance with this ordinance and N.J.S.A. 40A:4-45.14, be increased by 3.5%, amounting to $21,233.52 and that the CY 2021 municipal budget for the Township of Shrewsbury be approved and adopted in accordance with this ordinance; and,
BE IT FURTHER ORDAINED, that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years; and,
BE IT FURTHER ORDAINED, that a certified copy of this ordinance as introduced be filed with the Director of the Division of Local Government Services within 5 days of introduction; and,

BE IT ORDAINED, by the Township Committee of the Township of Shrewsbury in the
County of Monmouth and State of New Jersey:
SECTION 1. The offices and positions under the Municipal Government of the Township of Shrewsbury shall be compensated at the amount fixed in this Ordinance.
SECTION 2. The Township Chief Financial Officer is hereby authorized to transfer such sums of money from the Municipal Current Account and other such accounts that may cover periodic payrolls in the amounts fixed by this Ordinance.
SECTION 3. Effective January 1, 2020 all employees, eligible for health insurance shall make a contribution of salary towards health benefits based on the annual premium for all health care and prescription premiums as set forth in the schedule promulgated by the NJ Division of Pensions and Benefits herein attached and as revised from time to time. The minimum contribution shall be equal to 1.5% of the employee’s salary.
SECTION 4. The following listed positions are assigned to the following titles with annual salary ranges, providing for minimum and maximum salaries, contingent on merit, the availability of funds, and other provisions of this Ordinance. The Township Committee shall pass an annual resolution indicating the specific salary of each employee.

BE IT ORDAINED by the TOWNSHIP COUNCIL OF THE TOWNSHIP OF SHREWSBURY, IN THE COUNTY OF MONMOUTH, STATE OF NEW JERSEY (not less than two-thirds of all members thereof affirmatively concurring), AS FOLLOWS:
Section 1. The improvements described in Section 3 of this bond ordinance are hereby authorized as general improvements to be undertaken in and by the TOWNSHIP of Shrewsbury, in the County of Monmouth, New Jersey (the “TOWNSHIP”). For the improvements or purposes described in Section 3, there is hereby appropriated the sum of $71,250.00, said sum being inclusive of all appropriations heretofore made therefor and $3,750 as the down payment for said purposes as required by the Local Bond Law, N.J.S.A. 40A:2-1 et seq. The down payment is now available by virtue of provision for down payment or for capital improvement purposes in the Capital Improvement Fund of one or more previously adopted budgets
Section 2. In order to finance the costs of said improvements or purposes not provided for by the application of the down payment and reserve for insurance proceeds, negotiable bonds are hereby authorized to be issued in the principal amount not to exceed $71,250.00, pursuant to the Local Bond Law. In anticipation of the issuance of said bonds and to temporarily finance said improvements or purposes, negotiable bond anticipation notes are hereby authorized to be issued pursuant to and within the limitations prescribed by the Local Bond Law.
Section 3. (a) The improvements hereby authorized to be undertaken consist of the acquisition of Public Works Equipment/Vehicles, together with all purposes necessary, incidental or appurtenant thereto, all as shown on and in accordance with plans, specifications or requisitions therefor on file with or through the TOWNSHIP Chief Financial Officer, as finally approved by the governing body of the TOWNSHIP.
(b) The estimated maximum amount of bonds or notes to be issued for the improvements or purposes described in Section 3(a) hereof is $71,250.00, as stated in Section 2 hereof.
(c) The estimated cost of the improvements or purposes described in Section 3(a) hereof is $75,000.00, which is equal to the amount of the appropriation herein made therefor. The excess of the appropriation of $75,000.00 over the estimated maximum amount of bonds or notes to be issued therefor being the amount of said $3,750 down payment from grants in aid and other funds.
Section 4. All bond anticipation notes issued hereunder shall mature at such times as may be determined by the chief financial officer of the TOWNSHIP, provided that no note shall mature later than one (1) year from its date. All notes issued hereunder may be renewed from time to time subject to the provisions of N.J.S.A. 40A:2-8. The notes shall bear interest at such rate or rates and be in such form as may be determined by the chief financial officer, who shall determine all matters in connection with notes issued pursuant to this ordinance, and the chief financial officer's signature upon the notes shall be conclusive evidence as to all such determinations. The chief financial officer is hereby authorized to sell part or all of the notes from time to time at public or private sale and to deliver them to the purchasers thereof upon receipt of payment of the purchase price plus accrued interest from their dates to the date of delivery thereof. The chief financial officer is directed to report in writing to the governing body at the meeting next succeeding the date when any sale or delivery of such notes occurs, such report shall include the amount, the description, the interest rate and the maturity schedule of the notes sold, the price obtained and the name of the purchaser.
Section 5. The following additional matters are hereby determined, declared, recited and stated:
(a) The improvements or purposes described in Section 3 of this bond ordinance are not a current expense and are improvements or purposes that the TOWNSHIP may lawfully undertake as a general improvement, and no part of the cost thereof has been or shall be specially assessed on property specially benefited thereby.
(b) The average period of usefulness of the improvements or purposes, within the limitations of the Local Bond Law and taking into consideration the amount of the obligations authorized for said purposes, according to the reasonable life thereof computed from the date of the bonds authorized by this bond ordinance, is (10) ten years.
(c) The Supplemental Debt Statement required by the Local Bond Law has been duly prepared and filed in the office of the TOWNSHIP Clerk, and a complete executed duplicate thereof has been filed in the office of the Director of the Division of Local Government Services in the Department of Community Affairs of the State of New Jersey. Such Statement shows that the gross debt of the TOWNSHIP as defined in the Local Bond Law is increased by the authorization of the bonds and notes provided in this bond ordinance by $71,250.00 and the obligations authorized herein will be within all debt limitations prescribed by that Law.
(d) To the extent that moneys of the TOWNSHIP are used to finance, on an interim basis, costs of said improvements or purposes, the TOWNSHIP reasonably expects such costs to be paid or reimbursed with the proceeds of obligations issued pursuant hereto. This ordinance shall constitute a declaration of official intent for the purposes and within the meaning of Section 1.150-2(e) of the United States Treasury Regulations.
Section 6. The capital budget of the TOWNSHIP is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency herewith. The resolution in the form promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director of the Division of Local Government Services is on file with the TOWNSHIP Clerk and is available there for public inspection.
Section 7. Any grant or similar moneys from time to time received by the TOWNSHIP for the improvements or purposes described in Section 3 hereof, shall be applied either to direct payment of the cost of the improvements within the appropriation herein authorized or to payment of the obligations issued pursuant to this ordinance. The amount of obligations authorized but not issued hereunder shall be reduced to the extent that such funds are received and so used.
Section 8. The full faith and credit of the TOWNSHIP are hereby pledged to the punctual payment of the principal of and the interest on the obligations authorized by this bond ordinance. The obligations shall be direct, unlimited obligations of the TOWNSHIP, and, unless paid from other sources, the TOWNSHIP shall be obligated to levy ad valorem taxes upon all the taxable property within the TOWNSHIP for the payment of the obligations and the interest thereon without limitation as to rate or amount.
Section 9. This bond ordinance shall take effect twenty (20) days after the first publication thereof after final adoption, as provided by the Local Bond Law.

BOND ORDINANCE PROVIDING FOR IMPROVEMENTS TO BARKER AVENUE AND APPROPRIATING $210,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $41,500 BONDS AND NOTES TO FINANCE A PORTION OF THE COSTS THEREOF, AUTHORIZED IN AND BY THE TOWNSHIP OF SHREWSBURY, IN THE COUNTY OF MONMOUTH, NEW JERSEY
Section 1. The improvements described in Section 3 of this bond ordinance are hereby authorized as general improvements to be undertaken in and by the TOWNSHIP of Shrewsbury, in the County of Monmouth, New Jersey (the “TOWNSHIP”). For the said improvements stated in Section 3, there is hereby appropriated the aggregate sum of $210,000, which sum includes a $158,000 New Jersey Department of Transportation Grant (the “Grant”) and the sum of $10,500 from the Capital Improvement Fund. Pursuant to the Local Bond Law, N.J.S.A. 40A:2-1 et seq. (the “Local Bond Law”), specifically, N.J.S.A. 40A:2-11(c), as amended and supplemented, no down payment is required for the improvements and purposes set forth in Section 3, hereof, as such project is being partially funded by the Grant.
Section 1. For the financing of said improvements and purposes described in Section 3 hereof, negotiable bonds of the TOWNSHIP are hereby authorized to be issued in the principal amount of $41,500 pursuant to the Local Bond Law. In anticipation of the issuance of said bonds and to temporarily finance said improvements or purposes, negotiable notes of the TOWNSHIP in a principal amount not exceeding $41,500 are hereby authorized to be issued pursuant to and within the limitations prescribed by said Local Bond Law.
Section 3. (a) The improvements hereby authorized to be undertaken consist of Improvements to BARKER AVENUE, together with all purposes necessary, incidental or appurtenant thereto, all as shown on and in accordance with plans, specifications or requisitions therefor on file with or through the TOWNSHIP Chief Financial Officer, as finally approved by the governing body of the TOWNSHIP.
(b) The estimated maximum amount of bonds or notes to be issued for the improvements or purposes described in Section 3(a) hereof is $41,500, as stated in Section 2 hereof.
(c) The estimated cost of the improvements or purposes described in Section 3(a) hereof is $210,000, which is equal to the amount of the appropriation herein made therefor. The excess of the appropriation of $210,000 over the estimated maximum amount of bonds or notes to be issued therefor being the amount of said $10,500 from the capital improvement fund and $158,000 from the New Jersey Department of Transportation Grant for said purposes.
Section 4. All bond anticipation notes issued hereunder shall mature at such times as may be determined by the chief financial officer of the TOWNSHIP, provided that no note shall mature later than one (1) year from its date. All notes issued hereunder may be renewed from time to time subject to the provisions of N.J.S.A. 40A:2-8. The notes shall bear interest at such rate or rates and be in such form as may be determined by the chief financial officer, who shall determine all matters in connection with notes issued pursuant to this ordinance, and the chief financial officer's signature upon the notes shall be conclusive evidence as to all such determinations. (a) The improvements or purposes described in Section 3 of this bond ordinance are not a current expense and are improvements or purposes that the TOWNSHIP may lawfully undertake as a general improvement, and no part of the cost thereof has been or shall be specially assessed on property specially benefited thereby.
(b) The average period of usefulness of the improvements or purposes, within the limitations of the Local Bond Law and taking into consideration the amount of the obligations authorized for said purposes, according to the reasonable life thereof computed from the date of the bonds authorized by this bond ordinance, is (twenty) 20 years.
(c) The Supplemental Debt Statement required by the Local Bond Law has been duly prepared and filed in the office of the TOWNSHIP Clerk, and a complete executed duplicate thereof has been filed in the office of the Director of the Division of Local Government Services in the Department of Community Affairs of the State of New Jersey. Such Statement shows that the gross debt of the TOWNSHIP as defined in the Local Bond Law is increased by the authorization of the bonds and notes provided in this bond ordinance by $41,500 and the obligations authorized herein will be within all debt limitations prescribed by that Law.
(d) An aggregate amount not exceeding $36,000 for interest on said obligations, costs of issuing said obligations, engineering costs, legal fees and other items of expense listed in and permitted under N.J.S.A. 40A:2-20 is included as part of the cost of said improvements and is included in the estimated cost indicated herein for said improvements.
(e) To the extent that moneys of the TOWNSHIP are used to finance, on an interim basis, costs of said improvements or purposes, the TOWNSHIP reasonably expects such costs to be paid or reimbursed with the proceeds of obligations issued pursuant hereto. This ordinance shall constitute a declaration of official intent for the purposes and within the meaning of Section 1.150-2(e) of the United States Treasury Regulations.
Section 6. The capital budget of the TOWNSHIP is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency herewith. The resolution in the form promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director of the Division of Local Government Services is on file with the TOWNSHIP Clerk and is available there for public inspection.
Section 7. Any grant or similar moneys from time to time received by the TOWNSHIP for the improvements or purposes described in Section 3 hereof, shall be applied either to direct payment of the cost of the improvements within the appropriation herein authorized or to payment of the obligations issued pursuant to this ordinance. The amount of obligations authorized but not issued hereunder shall be reduced to the extent that such funds are received and so used.
Section 8. The full faith and credit of the TOWNSHIP are hereby pledged to the punctual payment of the principal of and the interest on the obligations authorized by this bond ordinance. The obligations shall be direct, unlimited obligations of the TOWNSHIP, and, unless paid from other sources, the TOWNSHIP shall be obligated to levy ad valorem taxes upon all the taxable property within the TOWNSHIP for the payment of the obligations and the interest thereon without limitation as to rate or amount.
Section 9. This bond ordinance shall take effect twenty (20) days after the first publication thereof after final adoption, as provided by the Local Bond Law.

CALENDAR YEAR 2020 ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK
(N.J.S.A. 40A: 4-45.14)
WHEREAS, the Local Government Cap Law, N.J.S. 40A: 4-45.1 et seq., provides that in the preparation of its annual budget, a municipality shall limit any increase in said budget up to 2.5% unless authorized by ordinance to increase it to 3.5% over the previous year’s final appropriations, subject to certain exceptions; and,
WHEREAS, N.J.S.A. 40A: 4-45.15a provides that a municipality may, when authorized by ordinance, appropriate the difference between the amount of its actual final appropriation and the 3.5% percentage rate as an exception to its final appropriations in either of the next two succeeding years; and,
WHEREAS, the Township Committee of the Township of Shrewsbury in the County of Monmouth finds it advisable and necessary to increase its CY 2020 budget by up to 3.5% over the previous year’s final appropriations, in the interest of promoting the health, safety and welfare of the citizens; and,
WHEREAS, the Township Committee hereby determines that a 3.5 % increase in the budget for said year, amounting to $ 5,684.56 in excess of the increase in final appropriations otherwise permitted by the Local Government Cap Law for a total increase of $19,895.96, is advisable and necessary; and,
WHEREAS the Township Committee hereby determines that any amount authorized here in above that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years.
NOW THEREFORE BE IT ORDAINED, by the Township Committee of the Township of Shrewsbury, in the County of Monmouth a majority of the full authorized membership of this governing body affirmatively concurring, that, in the CY 2020 budget year, the final appropriations of the Township of Shrewsbury shall, in accordance with this ordinance and N.J.S.A. 40A: 4-45.14, be increased by 3.5 %, amounting to $19,895.96, and that the CY 2020 municipal budget for the Township of Shrewsbury be approved and adopted in accordance with this ordinance; and,
BE IT FURTHER ORDAINED, that any that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years; and,
BE IT FURTHER ORDAINED, that a certified copy of this ordinance as introduced be filed with the Director of the Division of Local Government Services within 5 days of introduction; and,

ORDINANCE PROVIDING FOR LOCAL ENFORCEMENT OF THE NEW JERSEY
UNIFORM FIRE CODE IN SHREWSBURY TOWNSHIP
WHEREAS, the Uniform Fire Safety Act, (P.L. 1983, c.383) was enacted for the purpose of establishing a system for the enforcement of minimum fire safety standards throughout the State of New Jersey; and
WHEREAS, the New Jersey Department of Community Affairs has promulgated minimum fire safety standards which have been made part of the Uniform Fire Code (N.J.A.C. 5:70.1 et seq.); and
WHEREAS, the Uniform Fire Safety Act authorizes municipalities to provide for local enforcement of these standards and to establish local enforcement agencies for that purpose; and
WHEREAS, it is in the best interest of the Township of Shrewsbury to have the Uniform Fire Code enforced locally; and
WHEREAS, the local fire service has agreed to the plan, which is set forth herein, for the administration and enforcement of the Uniform Fire Code.
NOW THEREFORE BE IT ORDAINED, by the governing body of the Township of Shrewsbury in the County of Monmouth and the State of New Jersey, as follows:
Section 1. LOCAL ENFORCEMENT
Pursuant to Section 11 of the Uniform Fire Safety Act (P.L. 1983 c. 383), the New Jersey Uniform Fire Code (N.J.A.C. 5:70.1 et seq.) shall be locally enforced by the Code Enforcement/Fire Sub Code Official or Fire Marshall of Shrewsbury Township.
Section 2. AGENCY DESIGNATION
The local enforcing agency shall be the Borough of Eatontown Fire Department, or other adjoining municipalities through a Shared Service Agreement through its Bureau of Fire Prevention which is hereby created therein. The Bureau of Fire Prevention shall hereinafter be known as the local enforcing agency.
Section 3. DUTIES
The local enforcing agency shall enforce the Uniform Fire Code in all buildings, structures, and premises within the established boundaries of the Township of Shrewsbury other than one and two unit owner-occupied dwellings used exclusively for dwelling purposes and buildings, structures, and premises owned or operated by Federal Government, Interstate Agencies or the State.
The local enforcing agency shall faithfully comply with all the pertinent requirements of the Uniform Fire Safety Act and the Uniform Fire Code.
Section 4. ORGANIZATION
The Bureau of Fire Prevention established by Section 2 of this Ordinance shall be under the direct supervision and control of a fore official who shall report to the Chief of the Fire Department. (Or Code Enforcement Officer)
The Bureau of Fire Prevention shall have at least one paid inspector.
Section 5. APPOINTMENTS, QUALIFICATION, TERM OF OFFICE, REMOVAL
Appointment and Qualifications of the Fire Official. The fire official shall be certified by the State and appointed by the governing body from a list of three names submitted by the Chief of the Fire Department.
Appointment and Qualifications of Inspectors and Other Employees.
Inspectors and other employees of the enforcing agency shall be appointed by the governing body upon recommendation of the fire official. All life hazard use inspectors shall be certified by the State.
Appointment of Legal Counsel.
The governing body shall specifically appoint legal counsel to assist the agency in enforcing the Uniform Fire Code.
Term of Office.
The Fire Official shall serve for a term of a minimum of one year. Any
vacancy shall be filled for the unexpired term.
Removal from Office.
The fire official, inspectors and other employees of the agency shall be subject to removal by the governing body for just cause. Before removal from office, all persons shall be afforded an opportunity to be heard by the governing body of a hearing officer designated by the same.
Section 6. LIFE HAZARD USES
The Bureau of the Fire Prevention established by Section 2 of this Ordinance shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of the New Jersey Department of Community Affairs.
Section 7. NON LIFE HAZARD USES
In addition to the registrations required by the Uniform Fire Code, the following non-life hazard uses shall register with the Bureau of Fire Prevention. These uses shall be inspected once per year and pay an annual fee. The fee schedule is as follows:
